Lor hheaJ
E,etmrve DueUOr
,.r~~na~~l R Long
Drvieiun Director
On November 21, 1997, the Division conducted an inspection of the proposed Stone
Gravel Pit permit area and observed evidence of recent exploration activities. DMG
records indicate that exploration activities were conducted prior to submittal of
Notice of Intent to Conduct Exploration Operations.
We believe this is in violation of Section 34-32.5-113(1) of the Colorado band
Reclamation Act for the Extraction of Construction Materials, 34-32.5-101 et sec .,
C.R.S. (1995 Repl. Vol.).
Therefore, we have found reason to believe a violation exists to the Law and have
scheduled this matter before the Mined Land Reclamation Board.
A Formal Public Hearing will be held during the January 28-29, 1998, Board
meeting for consideration of possible violation. The hearing will be held at 1313
Sherman Street, Room 318. Denver, Colorado, beginning at 9:00 a.m. or as soon
thereafter as the matter can be considered. You will have the opportunity to be
represented and heard. It will be reiterated that there is reason to believe that you
aze irr violation of the provisions noted above.
If they Board finds a violation at the hearing, it may issue a cease and desist order
and assess civil penalty of not less than $50.00 per day nor more than $200.00 per
day 6~r each day the land has been affected. Such penalties shall be assessed for not
less than one day and not more than sixty days. Concurrently with. the issuance of
such an order, the Board or the Office may seek a restraining order or injunction.
In addition to the civil penalty, the Board may assess against the violator, any cost
incurred by the Board or Office in carrying out corrective action.
