Included with that
application was the required $6500 permit amendment fee. Subsequently, and prior to
Mined Land Reclamation Board (MLRB) action on this application, Henderson, in
conjunction with the DMRS, determined that AM-OS was not necessary for the
immediate task of construction of the ultimate interceptor canal around the tailings
facility. Further action on AM-05 was terminated by both parties at that time.
Henderson is officially withdrawing AM-OS and submitting a completed application for
AM-06. In resubmitting an amendment application under AM-06, Henderson is
requesting that the application fee for AM-OS be applied to processing of AM-06.
The primary purpose of AM-06 is to increase the affected land area at the Henderson mill
site by 95 net acres and to provide an updated affected land area map using advancements
in mapping technology. As discussed in the text, this map represents a more accurate and
comprehensive affected land boundary for the Henderson mill site.
If you have any questions regarding this application, please do not hesitate to call me at
303-569-3221 x2284.
Sincerely,
Tim Haynes
Environmental Engineer
Henderson Operations
thaynes@phelpsdodge.com
cc: Bryce Romig, Environmental Manager, Colorado Operations
