Contact was made by Mr. Formaz. <br />Oct. 78 - Formaz submitted remaining 5 items requested and never <br />heard of the matter again. <br />Conclusion: Formaz thought they had met the requirements of the State. <br />Sept. 9, 81- Letter from Joe Zalkin advising they were out of compli- <br />ance and Sited several paragraphs in the Regulations. <br />Sept. 9 - 21 Telephone call to Joe discovered the material sent by <br />Formaz was missing from the file and there was no record <br />of payment of filing fee($125). Joe suggested buying Regs. <br />Sept. 21, 81 Formaz resubmitted all information including xerox <br />copy of the filing fee. They also sent Ck.~6 2271 for <br />$2 for a copy of the Regulations. Mrs. Formaz again <br />tried to contact the Wildlife Officer, but then decided <br />to wait for the Regulations to know what she needed. <br />Sept. 21 81 to Nov. 29, 1983- The Regulations were never recieved nor <br />Formaz never heard another word. <br />Conclusion: Formaz thought they had met the requirements and thought <br />the wildlife report had been submitted. The; still never <br />realized a Permit would be issued and was unaware of <br />bonding requirements. <br />Nov. 29, 1983 Letter from Mark Loye advising they were out of <br />compliance again siting paragraphs in the Regulations. <br />Dec. 1, 83 Mr. Formaz immediately called Mark and the entire history <br />was reviewed. Mark advised them to order a copy of the <br />regulations and to out-line by letter what had taken place. <br />This was the first time Formaz learned of mapping require- <br />ments or of a surity bond. (Formaz has never been asked <br />to post a bond in any of their contract work). <br />Dec. 2, 83- Mrs. Formaz wrote a detailed letter of their understand- <br />ing and enclosed Check ~/ 1191 for $2 for Regulations. Even <br />• to this date the check has not been returned or Regulations <br />recieved although Mark saw the check and the Certified <br />mail receipt was returned to Mrs. Formaz.(dated Dec. 5th) <br />Dec. 2 - 15 Formaz understood they really did not need to be present <br />for the Board Hearing on Dec. 15, 1983, if they followed <br />the Regulations. <br />Dec. 15, 83 A Cease & Desist Order was directed to the staff. <br />Dec. 16, 83 Rapp discussed the Board action with Formaz and agreed <br />to come to Gunnison. <br />Dec.17, 83 Formaz saw the Regulations for first time and realized <br />what a completed application required. <br />Jan 9, 84 Rapp delivered a completed application to Mark Loye, who <br />promptly reviewed it and okayed legal notice to paper. <br />Jan 18, 84 Rapp received an adequacy letter from Rocky.
