M-77-210 <br />Notice of Violation No. M-89-015 <br />' Dear Mr. Morgan: <br /> On August 23, 1989, the Colorado Mined Land Reclamation Board found Castle <br /> Concrete Company 1n violation of the Colorado Mined Land Reclamation Act <br />' (34-32-101 et seq., C.R.S. 1973 as amended) for failure to: <br /> a. Minimize disturbances to the prevailing hydrologic balance of 'the effected <br /> Land and of the surrounding area and to the quality and quantity of water <br /> in surface and groundwater systems during the mining operation; <br /> b. Protect areas outside of the affected land from slides and damage occurring <br />' during the mining operation; and <br /> c. Stab111ze and protect surface areas of the affected land, so as to <br />' effectively control erosion and attendant air and water pollution.-- <br /> As a result, the Board, in Notice of Violation (NOY). No, M-69-015 ertd the <br />' October 18, 1989 Notice of Violation modification, ordered Castle (;oncrete Company <br /> to develop final corrective action plans for the reclamation of these off-site <br /> disturbances by November 15, 1989. To date, Castle Concrete Company has submitted <br /> two separate Corrective action plans: the Phase One plan, submitted on July 11, <br />' i9B9, and the quarry Access Road plan, submitted on October 6, 198!). <br />' We have reviewed these plans for technicai adequacy, compllartce with the Board <br />orders, and compilance with applicable sections of the Colorado Mined Land <br /> Reclamation Act. Our adequacy comments are es follows: <br />' Phase'One Corrective Action Plan <br /> 1. Please provide the acreage of the off-Site area disturbed by tfie west slope <br />' rock slide. <br /> 2. Please provide a maD delineating the Dermit boundary increase necessary to <br />t encompass this disturbance. <br />
