You attended the conference reor?renting TBM, and Joe Dudash,
Dan Mathews and Dan Hernandez representing the Division, in addition to me.
As a result of my deliberations, I granted a continuance of the conference
regarding NOV's C-92-013 and C-92-014. I upheld NOV's C-92-020 and C-92-021,
but modified both recommended penalty assessment<_, as r?flectea in the
enclosed settlement agreements.
You pr?rented a oer;ua5ive argument in TBId's def?n5e in response to NO1/'s
C-:2-'~13 and C-92-014. Very brie~ly ;sated, it is your ccnLenticn that the
in5tantaneDUS runoff r?sulting from the UnUSUdI Dr?C'pl`-3" Cn ?v2nL '.ahiCh lead
tC% Lae I55UdnC2 of bCLh `/lOldtlCnS ?>(C?eded the lnStan=sae^_U5 rUnOif 'Nh'Cfl
~.vculd have resulted frcm Lhe 2.9 inch, 10 year/2a hour event applicable to Lhe
T614 mine sits. Therefore, you conclude that TBM should be ?'<emcted frcm both
violations, as allowed by our regulations. In support of t~is contention, you
pr?rented detailed precipitation r=cords compiled by an immediate neighbor of
the mine, who happens to be an engineer.
