<br /> <br />NOV C-94-004 <br />Foidel Creek Mine <br />This NOV was issued for failure to minimize disturbance to the <br />prevailing hydrologic balance. <br />HISTORY <br />No NOV's have been issued at this mine during the past twelve <br />months. No penalty is assessed for history. <br />SERIOUSNESS <br />An undetermined amount of sediment and drill cuttings left the <br />permit area as a result of untreated runoff entering streams. Off- <br />site impacts to the hydrologic balance which could have been <br />prevented with available technology are significant. $1000 is <br />assessed for the significant seriousness of this violation. <br />FAULT <br />Apparently, the operator did not take any measures to prevent <br />runoff from a drill pad or the cuttings on that pad from leaving <br />the site. Treating and controlling runoff from mine related <br />disturbances is an integral part of the mine permit which the <br />operator is very familiar with. The operator was negligent in not <br />taking any measures to prevent untreated runoff from leaving the <br />site. $750 is assessed for negligence. <br />GOOD FAITH <br />There is no evidence of good faith in the file at this time. <br />c:\wp51\42094 <br />
