The Animas Consolidated <br />Ditch Comparry was not notified of these plans or asked or comment, as we should have been. The ditch is <br />on the west boundary of the permit area. The ditch company aggressively protects easements and resists <br />encroachments along the ditch bank. We would like to be informed of all planned activity that could affect <br />the ditch. <br />We have two concerns about this proposed mining <br />• Water from the Animas Consolidated Ditch cannot be used for mining, or mitigating <br />evaporative loss It coo only be used for agricultural purposes. <br />• The ditch company has a diversion on the Animas River that must be maintained <br />periodically due to natural erosion.
