Animas Consolidated Ditch Comparry
P.O. Box 3345
Durango, CO 81302
Colorado Department of Minerals & Geology
Attn: Colorado Mined Land Reclamation Board
701 Camino del Rio #125
Durango, Colorado 81301
March 27, 2002
Dear Sir or Madam,
RECEIVED
APR. 0 8 2002
Division of Minerals and Geology
The plans to restart mining in the Thomas gravel pit have come to our attention. The Animas Consolidated
Ditch Comparry was not notified of these plans or asked or comment, as we should have been. The ditch is
on the west boundary of the permit area. The ditch company aggressively protects easements and resists
encroachments along the ditch bank. We would like to be informed of all planned activity that could affect
the ditch.
We have two concerns about this proposed mining
• Water from the Animas Consolidated Ditch cannot be used for mining, or mitigating
evaporative loss It coo only be used for agricultural purposes.
• The ditch company has a diversion on the Animas River that must be maintained
periodically due to natural erosion. We aze extremely concerned that the proposed plans
for [he mining in the river would compromise the ditch diversion through headword
' '- ~ ~ erosion If this should happen, the ditch company will hold the mine operators and
' their regulatory agencies responsible for mitigating and correcting the problem.
The proposed mine operators should be made fully aware of this.
Should you have any questions, please contact me at 259-7048 or 749-7795.
Thank you,
~~N
76hn Ott, President
Animas Consolidated Ditch Company
Cc: Army Corps of Engineers, LaPlata County Planning Department, Wally Ericson Colordo Dept. of
Minerals and Geology
