CERTIFICATION .OF RECORD
Upon consideration of the PLaintiffs' Complaint in the
above-captioned action and the Affidavit of Terry L. Sadler, and
the Court being satisfied that t'he Board should be directed to
certify to the Court its complete record and proceeding with
respect to the subject application, including all transcripts of
all such proceedings,=and the Court
FIND.[NG AND CONCLUDING that irreparable injury to
Plaintiffs may occur if Che issuance of the permit complained of
in Plaintiffs' Complaint is not stayed pending judicial review;
it is
ORDERED that the Colorado Mined Land Reclamation Board
is to certify Co this Court on or before the day of November,
1980, its entire record and proceedings, including transcripts
of all proceedings before the Board, concerning the application
of Oren R. Spillers, complained of in Plaintiffs' Complaint; and
it is
FURTHER ORDERED that the issuance of the subject permit
by the Colorado Mined Land Reclamation Board to Oren R. Spillers
complained of in Plaintiffs' Complaint is, stayed pending judicial
review.
