Ft <br />.~ appears that the fugitive dust control plan submitted by Sommerset Mine Is <br />nor adequate to control this problem. Although the Division did not <br />obserc•e any coal truck traffic dunng a recant irLSpectlon in the area, we :will <br />request a revised control plan from Sotnmerset. Such a request will require <br />a plan that limits the amount of coal contained in the trucks and covering <br />the loaded trucks to prerent spillage and blowing-dust. <br />I have requested that Scott Ivfiller of our Grand Junction office make an <br />insppection of the Somzncrse: none operation and determine what if any, <br />additional elements of a conaol plan are cecessarv. ~1r. Miller ,vould also <br />deterntitte whe:her compliance :~,ith all applicable permit conditions, fu itive <br />particulate control plans and state air quality control regtllasions are b eing <br />met. <br />Unfortunately, tht; Division has no authority to regelate exhaust from diesel <br />tn.clcs outside of the AIR~ proeram area which is basically the Front Flange <br />of Colorado. However, dir. ;vfoschner has the option oi' approaching his <br />city or county govr.-amen[ and ask them to consider making a request to <br />the State Heslth Department and the De anment of Revenue for inclusion <br />in the diesel opacity prugraul. A copy ufpRe;ulation No. 13 is attached for <br />your revie:v. This proce<s can be involved and wdll not offer any immediate <br />relief for \2r.
