These actions are based on the recommendations of the <br />conference officer who presided over the assessment conferences for the NOV's. Based on <br />information presented at those conferences, the Division is reducing the proposed civil <br />penalty for NOV C-96-005 from $2100 to $1350. NOV C-96-011 is being vacated. NOV <br />C-96-006 is being modified to incorporate some of the citations previously included in NOV <br />C-96-011. As a result of this modification, the proposed civil penalty for NOV C-96-006 is <br />being increased from $1600 to $1850. <br />As noted on the enclosed letter from Sandy Brown, the enclosed settlement agreements <br />should be signed and returned to the Division within ten days of receipt if you agree with <br />these actions. If you disagree with the settlements, do not sign them. A Notice and Order <br />to Pay will then be sent to you, at which time you may request a Board hearing. <br />Sincerely, <br />Michael B.
