<br />• <br />MINE ID ~ OR PROSPECTING ID ;*: n+-?nnn-nQ~ <br />INSPECTION DATE: 7/t fl/nn <br />• 3 <br />(?age ?) <br />INSPECTOR'S INITIALS: JCS <br />OBSERVATIONS <br />This inspection was conducted in response to a written complaint to the Division alleging that the Ciry of Walsenburg was <br />conducting unpermitted mining on newly purchased property east of the City. In the case of inspections made of possible <br />unpermitted mining operations, the Division does not provide advance notice [o the operator . <br />The alleged mine site was located as indicated on the map supplied with the complaint. The site was inactive at the time of the <br />inspection. There were no personnel at the site and no equipment. Much of the disturbance at the site appeared old, but there <br />was evidence of recent mining activity in the form of stockpiles of sand and gravel and areas of fresh excavation. <br />Because the alleged operator was the Ciry of Walsenburg, this inspector went to the City offices where a meeting was held <br />with Mr. H.C. Summers, Ciry Finance Director, During this meeting, Mr. Summers admitted that the Ciry was taking material <br />from the site in question, and that the Ciry had no reclamation permit or waiver of permit For the operation. Mr. Summers <br />indicated that it was the City's belief that no permit was needed for the operation; since the material was being taken from Ciry <br />property far use at a City utility construction project. <br />Since the mining operation had begun and surface disturbance had resulted without a reclamation permit or waiver of permit <br />from the Board, the City is being sent a Reason To Believe (a Violation Exisis) letter and required to meet with the Mined Land <br />Reclamation Board in regard to the matter during the Board's August 24, 2000 meeting. This is a compliance issue that will be <br />included on Page 3 of this report. <br />Mr. Summers was very cooperative in providing information about the operation and indicated that the City was prepared to <br />do the proper thing including getting a permit if necessary. With Mr. Summers' permission, the site was revisited by this <br />inspector. During this second visit, measurements were made of both the pit and the recent disturbance by pace and compass. <br />As a result of those measurements, it is estimated that the unpermitted mining operation by the Ciry resulted in surface <br />disturbance totaling approximately 0.9 acre as illustrated below: <br />N <br />i <br />1 ~~(=~~~ <br />y6 <br />~,t ~ ~,~ <br />/ 4~~$~ <br />cc: Complaintant <br />1 & E Contact Address <br />~'~,~ <br />NAME: Mr. H.C.
