The Division, by letter dated November 20, 1991, <br />approved abatement extensions until January 22, 1992 on the basis <br />that heavy snowfall had prevented completion of the required work. <br />All areas in which the necessary abatement work must be done remain <br />under heavy snowcover, thus preventing completion of the required <br />on-the-ground remedial actions. <br />This request is made in accordance with the provisions of Rule 5 of <br />the regulations. Specifically: <br />Rule 5.02.2(2)(c) of the approved regulations provides that <br />Circumstances which may qualify a surface coal mining <br />operation for an abatement period of more than 90 days <br />are: <br />(iv) Where climatic conditions preclude abatement within 90 <br />days, or where, due to climatic conditions, abatement <br />within 90 days clearly would cause more environmental <br />harm than is would prevent ... <br />
