Require the operator and/or landowner to complete said application within 30 days if the <br />application is a 1 l0 permit amendment, within 90 days if it is a 1 l2 permit conversion <br />without objections, and within l20 days if it is a 112 permit conversion which receives <br />objections. <br />3. Require the operator to post adequate financial warranty to issue a permit within thirty <br />(30) days after approval of the application. <br />4. Require the operator and/or landowner to post an interim reclamation bond: <br />In the amount of $ 2,000.00 by November 20, 2000 . <br />CIVIL PENALTY (C.R.S. 34-32.5-124(7) MINING OUTSIDE of A PERMIT AREA <br />If the Board finds the operation to have disturbed acreage outside the permit area, the <br />Board should also assess the operator and/or landowner a civil penalty of no[ less than <br />$100.00 per day nor more than $1,000.00 per day for each day the land has been affected, <br />not to exceed 365 days. <br />In this case, the Office recommends that the Boazd could find 93 <br />days of violation at $ 100.00 per day, beginning with the date of <br />July 17, 2000, when the Division determined that no previous <br />disturbance occurred in the area outside the permit boundaries prior <br />to the issuance of this permit, and ending with October 18, 2000, <br />the date of the Board Meeting. <br />The total civil penalty of $ 9,300.00 is due 30 days from the date of the signed Board <br />Order. <br />SUSPENSION OF CIVIL PENALTIES <br />The Board may suspend all or a portion of the civil penalty to encourage timely compliance with the <br />corrective actions, and compliance with the Act and Rules and Regulations. <br />
