LmP,on <br />State Engineer <br />In 1989, the Colorado Legislature passed Senate Bill 120 which requires any gravel pit <br />in operation after December 31, 1980 that exposed ground water to the atmosphere after <br />December 31, 1980 to replace all water lost from the local stream system. It also requires that <br />well permits and substitute water supply plans or Water Court augmentation plans be obtained <br />for these pits. <br />As delegated through legislative intent, this office is in the process of determining which <br />gravel pits expose ground water and which do not. We may have sent you a letter requesting <br />this information previously, but our records indicate that we have not received a response. <br />Our office considers a pit to expose ground water if it has water in it for any part of the <br />year that is not the result of direct surface water diversion into the pit. In addition, if the pit has <br />to be continually dewatered, we consider it to expose ground water. The Colorado Division of <br />Minerals and Geology recently provided our office a copy of a report of a July 11, 1995 field <br />inspection of the County's above referenced pit indicating that this pit does expose ground water. <br />If the county claims this gravel pit does not expose ground water, or the exposure <br />occurred prior to December 31, 1980, please provide documentation of this claim. If the gravel <br />pit has exposed ground water after December 31, 1980 the county has the following <br />responsibilities: <br />A gravel pit well permit application and the associated $60 filing fee must be <br />submitted to the Colorado Division of Water Resources. <br />2. A substitute water supply plan to replace all water lost to the affected stream <br />system must be filed with the Colorado Division of Water Resources. The filing <br />fee associated with this plan is $1,343. <br />
