Lonti <br />Greeley, Colorado 80632 o,s,nn one<Inr <br />RE: La Poudre Sand & Gravel Mine, Permit No. M-83-090 <br />Deaz Mr. Gregg: <br />On May 14, 1999 the Division of Minerals and Geology conducted an inspection of the La Poudre Sand & <br />Gravel Mine, Permit No. M-83-090 and found the following: <br />An azea below the Sinclair product pipeline (which traverses the permit azea between the two major lakes) had <br />been washed out by flooding. The reclamation plan does not adequately address protection of the Sinclair <br />pipeline from slides or damage as a result of the mining and reclamation operation, a slurry wall was <br />constructed aoound Pits #5 and #6 which does not conform to the postmining land use, and the operator did <br />not have a plan to control the presence of Leafy Spurge on site. The operator was required to amend the <br />permit applicationto correct the problems on site by September 20, 1999. To date, the operator has not filed <br />the required permit amendment. <br />Based on the site inspections anal review of the file, the Division believes the Operator to be in possible <br />violation of; <br />• C.R.S. 34-32.5-116(1) for failure to perform the reclamation prescribed as approved in the permit by <br />constructing a slurry wall azaund Pits #5 and #6. <br />• C.R.S. 34-32.5-116(4)(h) for failure to minimize disturbance to the hydrologic balance by constructing <br />a slurry wall around Pits #5 and #6. <br />• C.R.S. 34-32.5-116(4)(1) & (j) for failure to protect the Sinclair pipeline from slides and damage as a result <br />of mining and reclamation and failure to stabilize all surface azeas of the affected land to effectively <br />control erosion. <br />• Rule 3.1.10(6) of the Construction Materials Rules and Regulations for failure to employ methods of weed <br />control for noxious weed species noted on site (Leafy Spurge). <br />The Division will scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the December 15-16, 1999 Board meeting for consideration of <br />possible violation.
