File No. M-1991-009 ,/ <br />White River Sand and Gravel Pit 110(c) Surety Increase SI-O1 <br />Deaz Mr. Paulson, <br />On December 26, 2002 the Division of Minerals and Geology (Division) approved a Surety Increase (SI-Ol ), in the <br />amount of $25,222, resulting from observations made during an inspection of the site conducted on October 9, 2002. <br />The site was re-inspected on June 30, 2004 as a result of reclamation measures completed at the site. The surety <br />amount was re-calculated based on observations made during the June 2004 inspection. On August 2, 2004, the <br />Division set the new bond amount at $19,493. The bond currently held is $5,000; therefore the new increase amount <br />is set at $14,493. <br />Rule 4.2.1 (2) of the Construction Materials Rules and Regulations states that In the event that the Office or Boazd <br />determines that the Financial Warranty (currently held for a permit) is insufficient to perform reclamation, the <br />Permittee shall have up to sixty (60) days to post additional Financial Waranty from the date of written notice from <br />the Office or Board of such insufficiency.
