<br />Draft Minutes Quarterly Meeting, June 20, 1990 <br />o Status Update for GEC Mine - MIRD believes this site should be in <br />reclamation by this fall; a settlement between the State Attorney <br />General and GEC is anticipated soon for recovery of additional <br />monies. MLRD will be responsible for contracting the reclamation for <br />the bulk of the permit area. Total bond recovery is uncertain, but <br />the reclamation costs may be about $600,000. The adjacent Southfield <br />Mine will probably obtain use of GEC's open pit for disposal of its <br />prep plant waste; MLRD has not received a permit application for this <br />purpose, as Southfield is still negotiating with Dr. Corley, owner of <br />the GEC property, for an agreement on the pit disposal plan. <br />Status Update for Trinidad Basin Hine - MLRD recently received a <br />request from the permittee for bond release at this mine. The <br />permittee has not submitted information, demonstrations, or pursued a <br />suggested postmining land use change to MLRD's satisfaction; and the <br />Division will not consider initiating bond release at this time. <br />MLRD plans to schedule a hearing before the Mine Land Reclamation <br />Board in July 1990 to attempt resolution of the problems with the <br />site, the landowner, and the company. The Division will recommend <br />forfeiture of the remaining bond and will work with the landowner to <br />get the reclamation finished. <br />Status Update for Newlin Creek Mine - In its response to <br />TDN No. 90-02-107-6 (TV6), ML.RD contacted Mr. Vento, who owns the <br />land adjacent to the permit area. Mr. Vento indicated that he had no <br />problem with the current permittee (Corley Company) reclaiming the <br />disturbance created on the Vento property by the previous operator <br />(Harrison-Western). A bank in Pueblo, Colorado, now holds this Vento <br />property in trust, and MLRD reported that similar permission for <br />reclamation of the off-permit disturbance had been obtained from the <br />bank. Copies of this correspondence are now in AFO's files. The <br />Division: sent a letter on June 7, 1990, to Dr. Corley (AFO does not <br />have a copy of this letter) directing him to accordingly complete <br />reclamation on the Vento property within 30 days (about mid-July) or <br />face possible enforcement action. Dr. Corley is reportedly <br />contesting whether he has the right to enter the Vento property. <br />AFO's Reclamation Specialist is currently evaluating other <br />correspondence recently submitted by MLRD which addresses other <br />issues remaining in the TDN. <br />o Status of Phase I Bond Releases at Newlin Creek and Bacon Mines - For <br />Newlin Creek, MLRD published a proposed 60-percent release on May 30, <br />1990. The Division believes that all issues from AFO's TDN that <br />pertain to the release have been satisfactorily addressed in its <br />recent response to AFO. The AFO Reclamation Specialist is currently <br />reviewing this TDN response package, which includes the Vento <br />properties' reclamation, the issue of post mine land use of the <br />access road, and certain permit deficiencies on sediment controls. <br />1 <br />
