Mr. James Miner , March 29, 1994 Page 2 1. A well permit must be issued for the gravel pit in accordance with §37-90-137(2) and (1 I), C.R.S. According to our records, the gravel pit well permit application was denied (13082-AD) on April 7, 1993 for failure to have a valid water supply plan. Please request reversal of this denial when you submit your letter of acceptance. No fees will be assessed for this reversal. 2. The total surface area of the groundwater exposed after December 3I , 1980 must not exceed 3.3 acres. Uses must not exceed 10.59 acre-feet of evaporative loss, 0.63 acre-feet of water lost in the product and 1.40 acre-feet of transit toss. Should,tlre total consumption exceed this amount prior to the expiration date of this plan, an amendment will need to be filed with this office. 3. In accordance with amendments to §25-8-202("1), C.R.S and Senate Bit] 89-181 Rules and Regulations adopted on Febmary 4, 1992, the State Engineer shalt determine if the substitute supply is of a quality to meet requirements of use to which the senior appropriation receiving the substituted supply has nornrally been put. As such, water quality data or analysis may be requested at anytime to determine if the requirements of use of the senior appropriator are met. 4. Approval of this plan is for the purpose as stated herein. Any additional uses for which the water may be used must first be approved by this office. The historic consumptive use credit from natural vegetation stated herein to offset gross evaporation was based on Hie assumption that llu: consumption was from precipitation. Any future additional historic consumptive use credit given (e.g., agricultural water transfer) for this site roust consider all previous credits given. 5. The replacement water which is the subject of this plan for existing depletions cannot be sold or leased to any other entity. As a condition of subsequent renewals of this substitute water supply plan, the replacement water must be appurtenant to this site until a plan for augmentation is obtained for evaporation losses and stream depletions. All documents which make the replacement water appurtenant to this site should be recorded with the county clerk and recorder and must be submitted ro this office. All replacement water must be concurrent with depletions in quantity, timing, and location. 6. Adequate accounting of diversion and replacement mus- be provided to the Division Engineer in Greeley and Water Commissioner (Mabel M. Cunning, Staz Route 2, 3422 Highway 52, Wiggins, Colorado 80654, 432-5521) on a monthly basis or other interval acceptable to both of them. The accounting form provided with your application is subject to modification and approval by the Division Engineer. Alt amounts shalt be in acre-feet.
