Box 198 <br />Glasgow, Kentucky 42141 <br />RE: Notice of Violation C-84-110 to Trinidad Basin Mining, and Your <br />Correspondence of June 15, 1984 <br />Dear Mr. Quinn: <br />I am replying to your concerns raised in the correspondence of June 15, <br />1984. <br />You requested that the Division vacate the Notice of Violation C-84-110 in <br />that you felt the notice was not justified. The Division staff cannot vacate <br />a Notice of Violation, and in this instance we feel that the notice was <br />justified in being issued. Any request for vacating a violation must be <br />addressed to the Division Director; Mr. Shelton. Trinidad Basin Mining does <br />have the option of contesting the facts and issuance of the violation in the <br />informal assessment conference process. <br />With respect to your second concern regarding written comments concerning <br />requirements of stipulations Nos. 7 and 8 to the permit, I would like to <br />reiterate my concern that written comments from the Division may be less <br />expedient in resolving these issues than in organizing a meeting between <br />yourself, Trinidad Basin Mining and your vegetation specialist. In our <br />telephone conversation of June 27, 1984 this was agreed to and tentatively <br />scheduled. <br />Under separate cover I am sending you a copy of the modification of the <br />deadlines for abatement you requested for this violation.
