(Page 2) <br />MINE ID # OR PROSPECTING ID # : nn_roA~nre <br />INSPECTION DATE: I>aramha~ r vr2nnv INSPECTOR=S INITIALS: ~.lldC_ <br />OBSERVATIONS <br />This Inspection was conducted at the request of the permitted operator via a written complaint. The site is <br />located in Bent County approximately 5 miles southeast of the town of McClave. fie pit is situated on an old <br />alluvial terrace of the Arkansas River and sits just north of the active channel of the river. The surrounding terrain <br />is typical short-grass prairie common to Southeastern Colorado. <br />Upon entry to the site, the following observations were made. <br />-The site is presently near maximum disturbance with highwalls along the west and north sides of the pit. <br />-There are two material stockpiles on site and the south one appears to have had a sizeable amount of <br />material removed from it recently. <br />-Little to no reclamation has been performed on the site. <br />The current permit holder is Bent County, however, they have apparently lost their access lease to the site and <br />would like to have the landowner transfer the pit into their name. This has not occurred to date and in the <br />meantime stockpiled material has reportedly been sold to a third party, Torrez Construction, and removed from <br />the site. Since Bent County is the operator, they are not allowed to sell material to a Third party, however, the <br />landowner is typically able to use material from county pits on their own land. The landowner is not, however, <br />allowed to sell material from a county permitted site to a third party. Therefore, a Reason to Believe That a <br />Violation Exists Letter is being sent to both the landowner and Torrez Construction citing that a possible violation <br />to C.R.S. 34-32.5-109(7) may exist for failure to first obtain a reclamation permit prior to engaging in a new <br />mining operation.
