We do not consider coal fines as
being a regulated discharge of fill material. However, the clean up work will likely
require permitting. I've included a permit checklist and application, along with
nationwide permit summaries for NW27 and NW33. If the creation of the temporary catchment
basin(s) can be conducted via excavation only, i.e. without placing any material within
the stream or adjacent wetlands, the creation will not require permitting. The
restoration of the stream would require permitting. The catchment basin should be placed
outside of wetlands, to the maximum extent practicable, and any wetlands that cannot be
avoided should be excavated in such a way that the top 12-18 inches of topsoil will be
stockpiled seperately from the sub-soil. During restoration the sub-soil should be placed
first with the topsoil spread back on top. In order to ensure a stable stream reach after
restoration, a longitudinal profile of the stream should be taken at the area of the
proposed catchment basin prior to excavation. Please feel free to contact me with any
questions. Thank you.
Sincerely,
Nathan Green
Regulatory Project Manager
U.S. Army Corps of Engineers
400 Rood Avenue, Room 142
Grand Junction, Colorado 81501
(970) 293-1199 ext. 12
www.spk.usace.army.mil/regulatory
***CORPS ENVIRONMENTAL PRINCIPLES***
--Strive to achieve environmental sustainability --Recognize the interdependence of life
and the physical environment --Seek balance and synergy among human development activities
and natural systems --Continue to accept corporate responsibility and accountability under
the law --Seek ways and means to assess and mitigate cumulative impacts to the environment
--Build and share an integrated scientific, economic, and social knowledge base --Respect
the views of individuals and groups interested in Corps activities
-----Original Message-----
From: Walker, Byron [mailto:byron.walke r@state.co.us]
Sent: Tuesday, September 12, 2006 10:49 AM
To: Green, Nathan J SPK; Haskins, Jim; Christopher Gates
(christopher.gates@state.co.us)
Cc: Jerry M.
