Long
Denver, CO 8~2~3 Division Dueuor
RE :Henderson -Groundwater Investigation
The Division of Minerals & Geology requests your continued assistance in evaluating possible impacts to a
number of groundwater users in the Henderson area from nearby, active sand & gravel pits. In particular, we
request written verification for each of the permitted operations listed on the following attachment of whether
they currently are or are not in compliance with all permitting requirements of the Office of the State
Engineer. We would appreciate a written response on or before March 20, 2001 if at all possible. In the
event that an operation is not in compliance with OSE requirements, it will particularly helpful to identify the
outstanding requirement(sl in order that these operations may be brought into compliance. This information
is• needed in order for the Division [o carry out our statutory responsibilities in a manner that is consistent with
our Memorandum of Understanding with the OSE (see attachment).
You may also want to consider whether our respective Division's need to meet in order [o work out what (if
any) joint enforcement actions may be required. The intent of this meeting will be to avoid any potential for
overlapping jurisdiction and to bring this matter to a mutually agreeble conclusion.
For your benefit, we have attached copies of previous correspondence between our Divisions on this
investigation as well as a synopsis of [he various operations in question. Once again, we appreciate your
cooperation in this matter and look forward to your response on or before March 20, 2001. Let us know if
you need any additional information.
Sincerely,
\ ---
Carl B.
