<br />NOV C-92-001 <br />Southfield Mine <br />Failure to construct coal processing waste pile according to the <br />approved plan; failure to maintain positive drainage on the pile. <br />HISTORY: No violations in the past 12 months. <br />SERIOUSNESS: Following review of materials submitted to the <br />Division in the aftermath of this NOV, it appears that the pile <br />meets all of the stability criteria required by the regulations. <br />However, the operator did ignore part of the approved construction <br />plan for an extended period of time during which the pile was being <br />built. Constructing the pile without an approved plan poses the <br />possibility of a failure with serious consequences. In addition, <br />the duration of impacts from such a failure would be major, due to <br />the difficulty of repairing the pile after a failure. Therefore, <br />this violation is seen as significantly serious. <br />FAULT: The operator was negligent in allowing construction of <br />the pile to proceed after materials going into the pile had changed <br />without reassessing and modifying the plan, as had been recommended <br />in the inspecting engineer's reports. <br />GOOD FAITH: Good faith is not applicable since the violation has <br />not yet been abated. <br />c:\wp51\lpr\1r25j <br />
