<br />Several months elapsed with no response from the operator. I made calls on a couple occasions to Garin <br />Harada, LEI's permitting contact to make request for the response, but no submittal was made until June <br />I8, 2001 after 1 had called Garin's supervisor Mark Wayment on June 14, and threatened enforcement <br />action if submittal was not made within one week. The responses committed to completion of reclamation <br />by the end of 2001, not by I I/I/01, as had been requested. In a letter of July 31,2001, DMG reiterated the <br />request for the I I/I/01 work completion deadline "because snow and winter conditions which could <br />possibly preclude work at the minesite become more likely in November and December". The DMG letter <br />also requested more specifics on volume and placement and compaction ofcoaly material at the Munger <br />Bench, because operator had atready placed a quantity ofcoaly material from the McClane site on the <br />Munger bench, and it was apparent that when the additional coal from Loma loadout was added, the <br />volume ofcoaly material would exceed that originally anticipated. A follow-up DMG letter of 8/20/01 <br />specified that the material be spread and compacted incompliance with 4.10.4(3)(a) and (b), and that the <br />placement and compaction be inspected and certified by aP.E. <br />,.. <br />_~ <br />fN <br />., I <br />~~. <br />_' .~~ t ~ <br />1.. <br />~~r, <br />DMG received adequacy responses on 10/2/01, and a proposed approval decision was published 10/20/01. <br />Coal from the Loma Loadou[ was loaded and hauled [o [he Munger bench during the first couple weeks of <br />October. A DMG inspection report of October 23, 2001 stated "[T]he additional coal material removed <br />from the loadout had been trucked to the Munger Bench and spread on top of the compacted coal material <br />previously placed. Operator indicated that results of additional material testing were being awaited prior to <br />final grading, compaction testing and certification, prior to placement of non-toxic cover". <br />An acceptable backfill certification was completed by Jim Stover on November 29, 2001. <br />
