STATE OF COLORADO MINED LAND RECLAMATION BOARD DEPARTMENT OF NATURAL RESOURCES IN THE MATTER OF: Echo Gold Corporation ) 7190 W. 29th Place ) BOARD pRDER Denver, CO 80215 ) TO: Mr. Albert F. Trues and all other persons engaged in or owning or controlling the follo~ing operation: Mackey Mine, Permit No. M-84-013. FINDINGS OF FACT Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Boazd by C.R.S. 34-32-124, the Board hereby makes the following findings of fact: 1. Echo Gold Corporation has obtained Permit M-84-013 as required by C.R.S. 34-32-101 et seg. to conduct a mining operation in the following location: Section 20, Township 2S, Range 73W, of the 6th P.M. in Gilpin County, Colorado 2. On March 24, 1998, the Mined Land Reclamation Boazd issued Notice of Violation MV-98-010 and a Cease and Desist Order. The Cease and Desist Order required certain corrective actions. 3. On Mazch 24, 1998, the Mined Land Reclamation Boazd assessed a Civil Penaltylin the amount of $225.00 to be paid no later than Apri127, 1998. 4. On May 27, 1998, the Mined Land Reclamation Board conducted a Formal Publi Hearing in accordance with C.R.S. 34-32-124(5) and 34-32-118(2) and determined that Echo G~Id Corporation has not complied with the terms of the Cease and Desist Order, the corrective action h~equired by the Cease and Desist Order, or submitted a Civil Penalty in the amount of $225.00. BOARD ORDER Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land Reclamation Board hereby order~Echo Gold Corporation to complete the following corrective actions no later than August 26, 19 8: 1. Reclaim the Mackey Mine site pursuant to the approved reclamation plan or 2. Complete a permit transfer and succession of operator for Permit No. M-84-013.
