ENGINEER CERTIFICATION <br />I, Stephen R. Hinkemeyer, being a registered professional engineer <br />in the State of Colorado do hereby certify that based on my <br />professional expertise, and the information provided to me by Mr. <br />Juan Garcia regarding theoretical hydrological modeling assumptions <br />arrived at through negotiations with the Colorado Division of <br />Minerals and Geology, the following information has been reviewed <br />by me and true and correct to the best of my knowledge. <br />1) The map titled "INITIAL WEST PIT STRIP AREA - INTERIM <br />DRAINAGE FLOW" approximates the hydrologic control as of <br />July 18, 1994. <br />2) The table titled "COLOWYO COAL COMPANY, INITIAL WEST PIT <br />BOXCUT TOPSOIL STRIPPING, INITIAL STRIPPING AREA DRAINAGE <br />ANALYSIS" approximates the hydrologic control as of July <br />18, 1994. <br />3) The drainage structure #1 West Pit Sediment Pond is <br />adequate to contain the predicted runoff or sediment <br />resulting from a 10-year, 24 hour precipitation event <br />occurring in drainage area #1. <br />4) The drainage structure #2 comprised of the in-pit initial <br />boxcut is adequate to contain the predicted runoff or <br />sediment resulting from a 10-year, 24 hour precipitation <br />event occurring in drainage area #2. <br />5) The drainage structure #3 comprised of an additional in- <br />pit control structure is adequate to contain the <br />predicted runoff or sediment resulting from a 10-year, 24 <br />hour precipitation event occurring in drainage area #3. <br />' ~9j~4p~Stephen R.
