The permit is set to expire May 12, 2007, as it was approved for a <br />term of 20 years. <br />The Division of Minerals and Geology notice dated January 12, 2006, received by this office on <br />January 23, 2006, references the application filed in.the Chaffee County Clerk and Recorder's <br />Office. In that application, it is noted that the application is to amend the existing operations <br />from the permitted 10 acres, to include an additional 10 acres currently being mined without a <br />permit, and to include an additional 52 acres into the permit for a total of 72 acres. These <br />conditions require an application to Chaffee County for a Mining Permit to cover the expanded <br />area. Additionally, Exhibit M of the mining application includes a statement that an application <br />for an Amended Chaffee County permit was to be submitted in the 4"' quarter of 2005. We have <br />not yet received an application for the mine expansion. <br />Many of Chaffee County's requirements are consistent-with the state's regulations; however we <br />do have some additional requirements, and therefore object to consideration or approval by <br />DMG on this application until the mine operator has applied for a County permit. <br />Further, we request that any approval granted on this or any other mining permit application in <br />Chaffee County include a condition that Chaffee County Land Use approval be received prior to <br />beginning any operations or issuance of the permit. <br />We appreciate your assistance in this matter.
