• a <br />10.3 Contractor agrees to disclose honestly and fully all inf rmation and <br />documentation in its possession concerning all transactions or events relating'to or affecting <br />BMRI, or any corporation affiliated with BMRI as and to the extent such information or <br />documentation (i) was acquired or developed by Contractor during its engagement under <br />this Agreement, and (ii) is requested by BMRI or the authorized representative thereof; <br />provided, that if Contractor indicates that the information or documentation requested is <br />privileged or confidential, appropriate steps will be taken to protect such privilege or <br />confidentiality to the extent possible consistent with the ethical and le®al obligations <br />applicable to such privileged and confidential information. However, the s@nsitive nature <br />of the information or documentation requested shall not diminish the ~ unconditional <br />obligation to disclose any such information or documentation to BMRI oNits authorized <br />representatives. <br />10.4 Contractor shall, at the request of this BMRI, render a certificate or sworn <br />affidavit to BMRI stating that Contractor has not violated any of the terms of this <br />Article 10. <br />Article 11 -Representations and Notices <br />11.1 Representatives of BMRI, DMG and Contractor for purposes of this <br />Agreement, unless expressly changed by notice to the other party, shall be the following: <br />-21- <br />
