If Contractor requests a modification of a Change Order, DMG and BMRI <br />shall have five (5) days from receipt of such request to accept such modification in writing. <br />If not so accepted, such request is deemed to be rejected. However, lif Contractor's <br />modification is not accepted, Contractor is not obligated to execute the Change Order. <br />Article 2 -Term <br />2.1 Subject only to Change Order(s) or the provisions for termina(ion set forth in <br />Article 8 below, Contractor shall, subject to the directions received from DIyIG pursuant to <br />the MOU, commence the Work on the effective date of this agreement. The term of this <br />Agreement shall be one (1) year unless terminated sooner pursuant to Artiicle 8 herein or <br />extended by Change Order pursuant to Article 1.5 herein. <br />2.2 If Contractor is delayed at any time in the progress of the Wbrk by Change <br />Order(s), by labor disputes, fire, unusual delay in transportation, adverse weather conditions <br />not reasonably anticipated, unavoidable casualties, or any other causes on acts of nature <br />beyond Contractor's control and without the fault or negligence of Contractor, Contractor <br />shall prepare and submit to DMG and BMRI within ten (10) calendar days of the <br />occurrence a written report of its assessment of the occurrence and ~ any proposed <br />amendment to the Term. Contractor shall proceed with due diligence to alldviate any such <br />delay and shall continue in the performance of its obligations hereunder. DMG in consulta- <br />-5- <br />
