The <br />review is to determine whether a pattern of violations exists or has existed, and, if a pattern <br />exists, whether we will require the operator to show cause why the permit should not be <br />revoked or suspended. <br />Peabody Western Coal Company was issued five notices of violation during three separate <br />inspections of the Seneca II-W Mine. The citations, in brief, were: <br />September 24. 1993 Inspection <br />NOV C-93-134 Failure to provide designs and construction certifications for <br />sediment control structures on Topsoil Stockpile QQ. <br />NOV C-93-135 Failure to control and prevent erosion and siltation from Road A. <br />NOV C-93-136 Failure to provide all information, as required by the regulations, <br />on blasting records. <br />October 16. 1993 Inspection <br />NOV C-93-141 Failure to conduct blasting to protect the environment from the <br />adverse effects of surface coal mining. <br />October 20. 1993 Inspection <br />NOV C-93-143 Failure to store salvaged topsoil on a stable surface, where it will <br />not be disturbed by mining operations. <br />
