C-81-038, NOV C-93-030; REQUFSP FOR EXTENSION OF AflATEMENP DATE <br />Dear Mr. Shuey: <br />Cyprus Orchard Valley Coal Corporation (~VCC) respectfully requests an extension <br />to the abatement date of April 21, 1993 set for NOV C-93-030. To develop a <br />stabilization plan, COVCC requires additional time to evaluate the geotechnical <br />report addressing the slide area and the pertinent regulatory requirements <br />involved. The geotechnical evaluation of the slide area was not received by <br />~VCC until the abatement deadline of April 21, 1993. <br />COVCC may have been able to accelerate completion of the geotechnical evaluation <br />had it been aware an abatement deadline of April 21 had been set. Due to the <br />apparent mishandling of the certified letter notifying COVCC of the violation, <br />appropriate personnel at the mine site never received the letter. An employee <br />of COVCC evidently signed for the letter on April 12 but the letter was not <br />routed correctly from that point. <br />COVCC is in the process of developing a plan to stabilize the slide area. COVCC <br />does not believe that any in¢ninent hazards associated with the slide exist for <br />employees, equipment, or environmental resources.
