As we are both aware, in order to abate the <br />violation, the Division of Minerals and Geology has required <br />Bowie to submit a technical revision to the above-referenced <br />permit by March 20 to reflect the addition of M.A.G. Mining, <br />Inc., the supplier of a portion of the mine's underground <br />workforce, to the permit, and to effect full compliance with <br />all applicable ownership and control requirements by March <br />31. <br />I advised you of Bowies concern that the cessation <br />order violations which the Applicant Violator System has <br />linked to the two owners and officers of M.A.G. Mining, Inc., <br />Messrs. Michael R. Stanley and Arthur White, Jr., may not be <br />fully resolved by March 31. Unless Howie receives reliable <br />assurances from the State of Kentucky that the violations <br />will be fully resolved by that date, or unless the Division <br />of Minerals and Geology is willing to consider an extension <br />of the March 31 deadline to accomplish resolution of the <br />violations (which would be Howie's preference), Bowie would <br />propose the following alternative approach for the Divisions <br />consideration. <br />
