(2) Special design and reclamation measures may be required in some of the Scenic and <br />Natural Values (SNV) (Visual Resource Management Class II[) stipulation area listed below in order to <br />protect the outstanding scenic and natural landscape values of the highway corridor and the wild horse <br />azea. The special desigrt and reclamation measures would be determined at mine development. Special <br />reclamation measures may include transplanting trees and shrubs, fertilization, mulching, special erosion <br />control structures, irrigation, and site recontouring to match the original contour. (1) Hefore undertaking any surface~isturbing activities on leased lands, <br />the lessee shall conduct an intensive (Class III) survey for cultural resources covering appropriate portions <br />of the mine plan and/or the exploration area. This inventory shall be conducted by a qualified <br />professional cultural resource specialist as defined in the Secretary of the Interior's "Archaeology and <br />Historic Preservation: Standazds and Guidelines." <br />(2) A report of the above inventory, including recommendations for protecting those <br />significant cultural resources identified, shall be submitted to the Assistant Director, Western Field <br />Operations, Office of Surface Mining Reclamation and Enforcement (OSMRE), and to the authorized <br />officer of the appropriate surface management agency. The lessee shall not commence surface-0isturbing <br />activities until permission [o proceed is provided by the OSMRE Assistant Director or by the appropriate <br />surface management agency's authorized officer. <br />(3) The lessee shall protect all significant cultural resources within the lease area until <br />appropriate measures to mitigate can be implemented as a part of an approved mining and reclamation <br />plan or an exploration plan. <br />(4) The cost of conducting the inventory, preparing reports, and carrying out adequate <br />mitigation measures shall be borne entirely by the lessee. <br />(5) If cultural resources are discovered during4perations, the lessee shall immediately notify <br />the OSMRE Assistant Director or the Bureau of Land Management's authorized officer. The lessee shall <br />not disturb such discoveries. Within five (5) working days, the Assistant Director (or authorized officer <br />of the appropriate surface management agency) will evaluate, or cause to have evaluated, any cultural <br />resources discovered and will determine if any action may be required to protect or preserve these <br />discoveries. Cost of recovery/mitigation of these resources shall be borne by the lessee. <br />(6) All cultural resources shall remain under the jurisdiction of the United States of America <br />until ownership is determined under applicable law. <br />
