<br /> <br />Monitoring of two Mann Draw alluvial wells wi1T continue. Past monitoring of <br />the wells noted dewatering from mining; rebound is occurring. No problems or <br />degradation of adjacent surface or ground waters has been noted. The drainage <br />design was evaluated by SEDCAO which indicated that the volume weighted peak <br />settleable solids levels from a 10-year, 24-hour event would be less than <br />5 mg/ml settleable solids. The probability of degradation of surface or <br />ground waters is very low. Continuing monitoring at the permit area should <br />evaluate the impact of a spoil aquifer on the surrounding area and the degree <br />to which water quality and slope stability are being preserved. <br />WCC has committed to the submittal of annual vegetative cover surveys and rill <br />and gulley assessments by September 1 of each year. if vegetative cover <br />should drop below twenty percent (20 q), Walden Coal will submit a mitigation <br />plan to the Division. <br />Prooosed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve a request for <br />partial bond release. This request was made by Walden Coal Company in <br />accordance with Rule 3.03.2 of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal tdining and the Colorado Surface Coal .Mining <br />Reclamation Act, CRS 34-22-101 et seq., Section 125. This proposed decision <br />is to release from bond and liability all back filling and grading work which <br />has occurred at the mine site to date. Bond shall be retained in an adequate <br />amount to cover reclamation of two wells, two temporary ditches, and the <br />successful establishment of vegetation; including soil preparation, seeding, <br />and mulching. In addition, bond will be retained to cover regrading of the <br />settlement cracks and reinstallation of the contour terrace bench System if it <br />does not function properly. <br />This approval decision is based on an inspection of the site and evaluation of <br />reclamation results. The amount of bond to be released is 5321.600.00. The <br />current bond liability of 5536,000.00 shall be reduced to 5214,400.00 when all <br />statutory notice and public comment requirements have been met. The Division <br />has calculated the amount required to conduct all remaining reclamation <br />activities. Based ort these calculations the Division proposes to release the <br />maximum a1]owable under Phase I bond release, (Rule 3.03.1 (2 )(a )). <br />0266E/scg <br />
