• Proposed Decision • <br />Partial Bond Release Request <br />Bourg Mine <br />Introduction <br />This document presents the results of the Division's review of Walden Coal <br />Company's request for partial bond release for backfilling and grading <br />completed at their Bourg Mine. Walden Coal Company (WCC) submitted a request <br />for partial bond release on April 7, 1989. This request for bond release is <br />in accordance with Rule 3.03.2. This review was conducted to fulfill the <br />requirements of Rule 3.03(2) and 3.03.2(5)(a). <br />Rule 3.03.2(2) requires the Division to conduct art inspection and evaluation <br />of the reclamation work involved after a request for bond release has been <br />received. The inspection to fulfill this requirement was conducted by the <br />Division on September 28, 1989. Surface owners within the permit boundary <br />were notified and offered the opportunity to participate in the ins pet ti on. A <br />company representative, Mr. Walter gyres, participated in the inspection. <br />Rule 3.03.2(5)(a) requires the Division to propose a decision on the bond <br />re]ease request and to provide written notification of the decision to the <br />permittee and other interested parties within thirty days of the inspection. <br />This proposed decision is subject to scrutiny by the permittee and other <br />interested parties. The Division's decision shall become final within thirty <br />days of its issuance unless a written request for an adjudicatory hearing is <br />received. This document includes the proposed decision, the evaluation, and <br />calculations to determine bond amounts retained and released. <br />
