Dear Mr. Mallory:
This formal notice of the action taken by the Mined Land Reclamation
Board on the above referenced matter at [heir April 26, 1979 rneeting.
The Board found that the Grassy Creek Mine operated by the Rockcastle
Company ha s. been in violation by failing [o salvage and stockpile
'prior to commencement of mining activities. In light of the evidence
provided in the findings of fact the Board voted to issue a Notice of
Violation, Cease and Desist Order and assess a civil penalty in the
' amount of three hundred (5300) dollars. The imposition of said
penalty was deferred until the May 23-24, 1979 Board meeting. The
Cease and Desist Order direct Rockcastle Company to discontinue mining
practices which result in the loss of or damage to topsoil.
The findings of fact, notice of violation, cease and desist order and
civil penalty are enclosed. Also note that the operator has the right
of appeal as set forth in the Mined Land Reclamation Act and the State
Administrative Procedures Act.
