In light of the evidence <br />provided in the findings of fact the Board voted to issue a Notice of <br />Violation, Cease and Desist Order and assess a civil penalty in the <br />' amount of three hundred (5300) dollars. The imposition of said <br />penalty was deferred until the May 23-24, 1979 Board meeting. The <br />Cease and Desist Order direct Rockcastle Company to discontinue mining <br />practices which result in the loss of or damage to topsoil. <br />The findings of fact, notice of violation, cease and desist order and <br />civil penalty are enclosed.
