<br />-2- <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land Reclamation Boazd, <br />written notice of your compliance with paragraph one (1) of this Cease and Desist Order. <br />3. Complece the following corrective action: <br />Operator must obtain the appropriate permit for this site. Fora 110 or reclamation- <br />only permit, application must be submitted within 60 days (by October 23, 1995) and <br />approved within 60 days of submittal (by December 22, 1995). Fora 112 permit, <br />application must be submitted within 60 days (by October 23, 1995) and approved <br />within 120 days of submittal (by February 20, 1996). <br />4. Pay the Colorado Mined Land Reclamation Boazd a civil penalty in the amount of $1000.00. <br />The entire civil penalty amount will be waived upon timely completion of the corrective action <br />outlined in this order. If the corrective action date for approval of an application submittal is <br />not met, the civil penalty becomes due and payable. <br />This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties are <br />advised to consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure <br />Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed within a <br />certain time, shall be construed as a permit or license co engage in any prospecting or mining <br />operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are advised to consult <br />C.R.S. 244106, as amended. <br />Dated at Denver this ~~ <br />~~~~ <br />day of ~ , <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />C <br />,L B.
