M-19790165 <br />Mr. Frei, <br />Thank you submitting this Technical Revision (TR). As Tony Waldron from the DRMS <br />discussed with you and listed in his inspection report, there is not clear documentation on <br />the reclamation plan and the post mining land use for the Frei Pit #3. Your TR goes a <br />long way in clarifying these issues. The original post-mining land use was established as <br />"undetermined". Though this TR the post-mining land use will be set as <br />IndustriaUCommercial. <br />After reviewing the permit file, I think there are some additional clarifications that are <br />needed. <br />In the permit file, the site was envisioned to have a 10 acre and a 0.9 acre lake. In a <br />October 22, 19791etter to the DMG the Operator states that they will submit a TR to deal <br />with changes/removal to the lakes, to certify that inert fill was used to fill the lakes (Rule <br />3.1.5(9)), and ensure the proper compaction of that Fll (Rule 3.1.5(9)). Based on your <br />TR map submission and through a recent inspection, it is appazent there are no lakes <br />presently on site. In order to process this TR the Division needs additional information <br />about the change in reclamation pertaining to the removal of the lakes, specifically that <br />the lakes are no longer part of the reclamation plan. The Operator also needs to submit <br />the information and certification required under section 3.1.5(9) for the fill that was used <br />to backfill the lakes and any other fill used on site. <br />Please clarify if any water structures will be left on site (Rule 6.4.7(2)(c)). The PUD map <br />includes an "open space" area that may be a pond or wetland, please clarify the post- <br />mining status of this feature. Will there be any stormwater control structures left on site? <br />The storage of recycled materials is not included in the mining plan, and recycled asphalt <br />or other similar materials maybe currently stored on site. Will there be any toxic or acid <br />forming materials left on site post-mining? If so, describe how they shall be handled and <br />disposed of in a manner that will control unsightliness and protect the drainage system <br />from pollution (6.4.7(2)(c)). <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
