d. Two power lines <br />Additional structures may exist. Note that the list of man-made structures may be changed once <br />the Applicant addresses the comments above on establishing which are the "affected lands" within <br />the proposed mine site. <br />Per Rule 6.4.19 please provide, as appropriate, one of the following for each of the significant man <br />made structures in or within 200 feet of the affected lands. <br />(a) Provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any damage to <br />the structure; or <br />(b) Where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by <br />activities occurring at the mining operation. <br />(c) Where such structure is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation activities, as <br />proposed, will have "no negative effect" on their utility. <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />This section may be adequate as submitted. This adequacy determination depends on submission <br />of additional information on the mining operations requested above regarding permanent man-made <br />structures. <br />Please note that the Applicant's responses to these adequacy review comments may bring up <br />additional adequacy questions that would require a response by the Applicant. <br />Given the extensive nature of the adequacy responses that the applicant has been asked the Applicant to <br />provide, the Division is requesting that the Applicant provide a complete revised application once all the <br />adequacy issues have been addressed. <br />Attached are agency comments that the Division has received to date. Please review these documents and <br />respond to that agency as needed. If those responses impact aspects of this application, please revise or <br />supply additional information to the Division as necessary. <br />I look forward to your response. Please allow adequate time for review before the November 21, 2006 <br />decision date. Rule 1.8.1 states that changes and additions to the permit application must be filed with the <br />Division and the County Clerk and Recorder. The applicant must also provide the Division with an <br />affidavit or receipt demonstrating that the change or addition was filed with the County Clerk and Recorder <br />no later than the close of business on the day the change was filed with the Division.
