The total surface area of exposed ground water and total consumption at each pit may not <br />exceed the amounts given in the attached tables. <br />2. The total amount of exposed ground water and dewatered area at the Pueblo East pit may <br />not exceed 12 acres. <br />3. Pumping for truck clean-out at the Pueblo West Pit may not exceed 32 acre-feet annually. <br />4. Anew well permit must be obtained for the Pueblo East Pit that allows for water use via <br />retention on product (wet mining and product washing). The well permit application received <br />on January 9, 2002 (receipt no. 486252) will be evaluated pursuant to this plan. <br />5. Documentation of Transit Mix's ownership of the claimed 2.92 cfs of the Hamp-Bell Ditch <br />rights must be provided to this office, the Division Engineer, and the. Water Commissioner <br />prior to expiration of the plan. <br />6. Release of the Pueblo waters must be uhder the Division Engineer's direction and approval. <br />7. All pumping for batch plant operations, material washing, or dust suppression must be <br />measured in a manner approved by the Division Engineer. <br />8. Accounting of all waters in this plah must be provided to the Water Commissioner and <br />Division Engineer on forms and at times acceptable to them. Said accounting must be <br />received by the 10~' of the month following the month being reported. The name, mailing <br />address, and phone number of the contact person who is responsible for operation and <br />accounting of this plan must be provided on the accounting forms. <br />9. Transit Mix must make application to the Water Court for a permanent plan for augmentation <br />for the Pueblo West Pit b~ the expiration date of this plan~Jan_uary 31_, 2003) to ensure the. <br />permanent replacement of all depletions, including long term evaporation losses after the <br />mining operations have ceased. Approval of this substitute supply plan does not imply a <br />position by this office on any related litigation. <br />10. Transit Mix must make application to the Water Court for a permanent plan for augmentation <br />for the Pueblo East Pit within the period 3 years prior to completion of mining, to ensure the <br />permanent replacement of all depletions, includ+ng long term evaporaton losses after the <br />mining operations have ceased. Approval of this substitute supply plan does not imply a <br />position by this office on any related litigation. <br />11. Should a request for renewal of this plan be needed, such renewal request must be <br />submitted to this office with the statutory fee of $217 at least 45 days prior to the expiration <br />date of this plan (December 16, 2002). <br />12. This plan shall be valid through January 31, 2003, unless otherwise revoked or modified. <br />13. This plan may be revoked or modified at any time should it be determined that injury to other <br />vested water rights has or will occur as a result of the operation of this plan. <br />
