III. Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules and <br />Regulations, and the permit also are identified below. <br />NOV C-85-003 was written for failure to minimize disturbance to the hydrologic <br />balance. Specifically, failure to ensure routing of runoff from a disturbed <br />area through a sediment pond. The disturbed area was anew coal stockpile <br />between State Highway 12 and the Purgatoire River. <br />Abatement for this NOV is to reestablish proper drainage along the north side <br />of the coal stockpile to prevent drainage from entering the Purgatoire River <br />by February 8, 1985. <br />NOV C-85-004 was written for failure to follow the approved mine plan. <br />Specifically, discharge of water (wash down and thickener) from the wash plant <br />which was approved as a closed system (no discharge). <br />Abatement for this NOV is: 1) cease discharge from the wash plant to Pond 7; <br />and, 2) Provide a spill containment plan for any discharge from the wash plant <br />if needed. These items must be taken care of by March 1, 1985. <br />
