This <br />plan was to be carried out by Las Animas County in lieu of payment of the <br />$3,000.00 unsuspended portion of the $10,000.00 civil penalty assessed against <br />Las Animas County for mining without a permit in the above captioned gravel <br />pit. <br />The area to be reclaimed is an old aggregate pit located about 1 1/2 miles <br />west of Segundo, having an area of about 5 acres, and owned by Mr. Orlando <br />Belardi. Our reclamation specialist, Linda Walker, inspected this site on <br />June 10, 1983 and made some recommendations in her inspection report (copy <br />enclosed). I have a]so enclosed a copy of the reclamation plan as submitted <br />by Mr. Hainlen. <br />In order to finally resolve this issue, Las Animas County should do the <br />following: <br />1. Commit to the reclamation plan submitted for this site. <br />2. Augment the existing plan by committing to recommendations Z, 3 and <br />4 of Linda Walker's June 10, 1983 inspection report and submit further <br />details for the plan (as necessary) in response to those recommendations. <br />Until such time as the reclamation of this site has been accomplished and, <br />after inspection by the Division staff, been released by our Board, the <br />payment of the remaining $3,000.00 civil penalty is merely held in abeyance, <br />not suspended.
