GOOD FAITH CERTIFICATION <br />Undersigned counsel has conferred with counsel for the other parties pursuant to <br />C.R.C.P. Rule 121, Section 1-15(8), and there are no objections to the relief sought herein. <br />The Plaintiffs filed their Complaint for Judicial Review in the above-captioned <br />matter on or about April 10, 2001. In their Prayer for Relief, the Plaintiffs asked the Court to <br />reverse the Board's April 10, 2001, order, and to affirm the Division of Minerals and <br />Geology's ("Division") decision to vacate Notice of Violation No. CV-2000-009 ("NOV"). <br />2. On or about April 10, 2001, accompanying their Complaint for Judicial <br />Review, the Plaintiffs filed Plaintiffs' Application for Temporary Relief The Court held a <br />hearing on the Plaintiffs' request for temporary relief on April 23, 2001. Following the <br />hearing, the Court granted the Plaintiffs' request upon the following findings: a) Plaintiffs <br />had a substantial likelihood of prevailing on the merits of their claim that the Division had <br />the authority to vacate the NOV, and b) Plaintiffs had a substantial likelihood of prevailing <br />on the merits of their claim that the administrative record lacked substantial evidence to <br />support a finding that Basin Resources, Inc., would be adversely affected by the Division's <br />vacation of the NOV. See Order Granting Temporary Relief, April 27, 2001 (Attached <br />hereto as Exhibit A). <br />On May 1, 2001, the Board filed its Motion to Stay and Request for <br />Authorization to Reconsider Board Order requesting the Court to stay the judicial review <br />proceedings and remand the April 10, 2001, order to the Board's jurisdiction for the purpose <br />of reconsideration. The Court granted the Board's request by its Order of Stay, filed May 2, <br />2001. <br />2 <br />
