Cottony <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the La Florida Pit 110(c) Conversion Application, File No. M-1987- <br />097. Your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />As required by Rule 1.6.5 (2), materials related to notice of all owners of record of surface lands, and <br />easement holders that are on the affected land and within 200 feet of the boundary of the affected land has <br />been received by the Division. The materials submitted by the Applicant, however, in the form of documents <br />related to certified mailings, were not postmarked or dated. The Division needs documentation of when the <br />letters were sent or received by the parties to be noticed. Please send copies of the returned, signed certified <br />mailing cards so that the Division has documentation regarding the date of notice to parties. <br />Please be advised that the Conejos County 110(c) conversion Application may be deemed inadequate, and the <br />application may be denied unless the above mentioned adequacy review items aze addressed to the satisfaction of the <br />Division. Responses to these adequacy concerns must be received by the Division to allow adequate time for review <br />prior to the decision date.
