<br />Fred Banta - 2 - August 24, 1990 <br />° On March 30, 1989, MLRD representatives met with Vance Mills of TBM and <br />Charles Baldwin. The matter of revising the postmining land use was <br />discussed, and we indicated that certain technical and legal questions <br />would need to be researched. <br />° On November 13, 1989, TBM submitted a one paragraph letter requesting <br />bond release. <br />° On November 15, 1989, Jim Pendleton, Mike Savage, and Randy Price <br />inspected the site to evaluate what would be needed from TBM to pursue an <br />alternative post-mining land use which would shorten the liability <br />period. Jim indicated that, given the steep slopes and loosely compacted <br />nature of the backfilled slopes, detailed engineering and geotechnical <br />demonstrations would need to be made in order for us to approve the <br />alternative residential land use. This conclusion was conveyed to TBM by <br />Mike Savage in a letter of November 21, 1989, along with an explanation <br />of the procedures which would need to be followed in requesting the land <br />use change and a description of Phase II bond release procedures. <br />° On January 5, 1990, we received a letter from Charles Baldwin vehemently <br />objecting to our requirements fora land use change. <br />° On January 10, 1990, OSM inspected the site and documented numerous <br />alleged violations. On February 2, 1990, OSM requested that we inform <br />them of what actions would be taken to resolve the performance standard <br />violations at the mine. <br />° We responded to OSM in a letter of February 14, 1990, indicating that we <br />were deciding on a course of action which might include either seeking <br />bond forfeiture or pursuing the land use change. <br />° On February 6, 1990, we received a letter from Vance Mills asking that we <br />consider the unique circumstances of his situation and he again requested <br />bond release (without providing any of the required documentation or <br />notifications). <br />° In a letter of March 23, 1990, from Mike Savage to Vance Mills, we stated <br />that it was TBM's responsibility to initiate and pursue solutions to the <br />concerns. We indicated that we had not yet received substantive <br />submittals regarding bond release or land use change. <br />° On July 20, 1990, OSM re-inspected TBM and again documented a number of <br />alleged violations including excessive erosion, slope instability, pond <br />outlet erosion and general drainage system disrepair. <br />° On August 1, 1990, we received another letter from Robert Hagen of <br />OSM-AFO requesting that we provide them with a schedule outlining a <br />course of action which we intend to pursue in order to abate the <br />violations. <br />
