Banta, <br />Division Direr~or <br />RE: H-G Coal Company (C-84-003) Notices of Violation C-90-042 and C-90-045 <br />H-G Coal Company has requested vacation of NOVs C-90-042 and C-90-045. <br />Following is additional information concerning the violations. <br />On September 27, 1990 a complete inspection was conducted at the H-G Mine. <br />During the course of the inspection two violations were discovered. C-90-042 <br />was issued for failure to clearly mark the perimeter of the permit area. <br />Specifically there is an area of land in the middle of the H-G load-out which <br />is not in the permit area but is completely surrounded by permit area. This <br />area was not marked at the site. The perimeter of the loadout is completely <br />fenced, however, it does not say that the fence will serve as the permit <br />boundary marker in the permit application and it is not specially marked (i.e. <br />signs, colored posts, plastic caps, etc.). Therefore, even though it may seem <br />obvious that it is the permit boundary it is not clearly identified as such <br />and the interior portion was definitely not marked. <br />NOV C-90-045 was issued for failure to maintain a culvert which was almost <br />completely clogged at the outlet. I have attached a memo which was written to <br />Jim Stevens for use in assessing the NOV which explains the violation. <br />If you have any questions, or require additional information, please see me. <br />1518E/scg <br />
