<br />-2- <br />THEREFORE <br />On April 24, 1996 the Colorado Mined Land Reclamation Board lifted the Cease and Desist Order <br />issued on March 27, 1996 for Permit No. M-83-084. This lifting of the Cease and Desist Order is <br />to allow mining to occur only within the currently disturbed portions of the permit area. Mining <br />beyond the currently disturbed pit boundary is not to take place, until the currently submitted <br />Amendment No. 003 for additional disturbance is approved, and the financial warranty associated <br />with this amendment. <br />All other conditions of the Notice of Violation remain in effect. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties <br />are advised to consult the Colorado Mined Land Reclamation Act and the State Administrative <br />Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain ads to be performed within <br />a certain time, shall be construed as a permit or license to engage in any prospecting or mining <br />operations within the State. <br />Persons concerned with judicial review of the provisions of the Order are advised to consult <br />C.R.S. 24-4-106, as amended. <br />6L~ <br />Dated at Denver this3 <br />day of C^-'~ `~ <br />MINED LAND RECLAMATION BOARD <br />COLORADO DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
