On 9j29J94, the above-referenced NOV was issued for failure to
submit hydrologic data in a timely manner. Specifically, permit
stipulation X32 requires:
The Hydrologic monitoring plan will consist of monitoring the
spoils well annually for water level and to submit the results to
the Division by October 31 of each year.
The 1992 report was submitted November 5, 1992. The 1993 report
was submitted January 6, 1994.
The request to vacate the NOV, received October 24, 1994, does not
substantiate the claim that a violation did not occur. While the
situation is truly insignificant, I believe that the stipulation is
clear, and a minor administrative violation did occur.
