MLRB et al. As you may be aware, the Court issued an order <br />on August 11, 2003, that the issuance of the permit for the above-referenced gravel pit is <br />remanded back to the MLRB to hold additional hearings. Thus, the MLRB permit for the Line <br />Camp pit is currently not valid It has recently come to my attention that Four States Aggregates, <br />LLC is continuing to operate this pit in violation of the Court's order. Therefore, this letter will <br />serve as a request for the Division of Minerals and Geology to order Four States to immediately <br />cease and desist all operations at the Line Camp Pit in accordance with C.R.S. § 34-32.5-123(1) <br />until it is determined whether the MLR$ permit will be reinstated. In addition, C.R.S. § 34-32.5- <br />123(2) provides that "an operator who operates without a permit shall be subject to a civil <br />penalty of not less than one thousand dollars per day nor more than five thousand dollars per day <br />for each day the land has been affected, not to exceed three hundred sixty-five days."
