Long <br />Drvnion Direao, <br />Re: NOV C-93-146, Notice of Proposed Amount of Civil Penalty, Request for Conference <br />Rimrock Coal Company, Rimrock Strip Mine, Permit No. C-89-074 <br />Dear Mr. Kerr: <br />On December 3, 1993, the Division incorrectly mailed a Notice of Proposed Amount of Civil <br />Penalty for NOV C-93-146 to Rimrock Coal Company rather than to Landmark Reclamation, <br />Inc. On December 8, 1993, Mrs. Gloria Davis received the Notice of Proposed Amount of Civil <br />Penalty. <br />The Division has yet to receive notification of the permittee's request for assessment <br />conference. We are re-mailing the Notice of Proposed Amount of Civil Penalty for NOV C-93- <br />146 to Landmark Reclamation, Inc., as LRI has been specifically identified as the designated <br />agent of service in Section 2.03.4 (Identification of Interest) in the permit. <br />Upon receipt of this second mailing of the Notice of Proposed Amount of Civil Penalty, you will <br />have ten days within which to request, on the form provided, an assessment conference for <br />NOV C-93-146. <br />Sincerely, <br />Wallace H.
